Note: Judgment of the European Court of Justice in a case concerning a Latvian Service provider in Sweden
On December 19, 2007, the European Court of Justice has decided in the case C-341/05, Laval, concerning the freedom to provide services of a Latvian company in Sweden. In this preliminary ruling, the Court has interpreted Art. 12 and 49 EC-Treaty and the Posting Directive.
This course concentrates on an important part of Business Law: EC Internal Market Law. It is a modified and simplified version of the course "EC Internal Market Law" at the Faculty of Law which has been adapted to the needs of the legal education of students of economics.
The European Union represents not only the institutional framework but as well the location for the substantive law of the European integration. The law of the European internal market forms the biggest part of that substantive law. This course deals with this subject, in particular with the economic fundamental freedoms of the citizens of the Union (free movement of goods, freedom of movement for workers, freedom of establishment, freedom to provide services, freedom of the movement of capital and of payments). These economic freedoms have a great impact on business in the European Union. The course will present the general theory and the specific features of the fundamental freedoms. It will introduce to the latest developments like the adoption of the controversial Services Directive in 2006. The course also deals with the approximation of laws in the internal market and the competition law of the European Union. As well, it presents an overview of the European Economic and Monetary Union.
The handling of practical cases normally is the task of legal experts. It is useful, however, to know some basics of it, in order to understand what the well-paid legal experts are doing (or should be doing). Therefore, the course will also contain a very short introduction to the techniques of case-solving in the field of EC Internal Market law. The case studies will deal with the economic fundamental freedoms.
Conditions: Open for students of all faculties. In order to get 4 credit points, participants are required to pass an interim examination (50 %) and a final examination (50 %).
